These Terms of Service (the "Terms") govern your access to and use of the website estatedit.com and the related membership services (collectively, the "Service") provided by The Estate Edit (the "Company", "we", "us", or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. Memberships, Billing, and Renewals

The Service is offered on a recurring subscription basis. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis at the then-current price for your selected plan until you cancel.

• Subscriptions automatically renew at the end of each billing cycle.
• You may cancel at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing cycle.
• We may change pricing or features by giving you reasonable advance notice. Changes apply to the next billing cycle.
• Failure to pay may result in suspension or termination of access.

4. Refund Policy

All payments are final and non-refundable, including for partial billing periods, unused time, or features you choose not to use. If you believe a charge was made in error, contact us at hello@estatedit.com within 14 days and we will review your request in good faith.

5. Content License to Members

When you have an active paid membership, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the templates, captions, graphics, copy, video assets, and other materials we provide (the "Content") for your personal real-estate marketing — meaning marketing your own real estate business, listings, and brand on social media, in client communications, and in other marketing channels.

You may NOT:

• Resell, redistribute, sublicense, or share the Content with anyone outside your team.
• Use the Content to create a competing template, content, or coaching product.
• Claim authorship or ownership of the Content.
• Remove copyright or attribution notices we include.
• Use the Content after your membership ends, except for content you have already published.

All Content remains the exclusive property of the Company and our licensors. Nothing in these Terms transfers ownership of the Content to you.

6. Your Content

You may submit your own content to the Service (for example, captions you save or edits you make to a template). You retain ownership of anything you submit. You grant us a limited license to host, store, and display your submissions solely to provide the Service to you.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any law.
• Share your account credentials with anyone outside your immediate team.
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Service.
• Upload viruses, malware, or harmful code.
• Harass, threaten, or abuse other users or our staff.
• Use the Service in a way that disrupts or burdens our infrastructure.

8. Third-Party Services

The Service integrates with or links to third-party services (such as Stripe, Instagram, and Facebook). We are not responsible for the availability, content, or practices of those services. Your use of them is governed by their own terms and privacy policies.

9. Disclaimers

THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any specific marketing result (leads, listings, sales, or income) will be achieved by using the Service. Your real-estate business results depend on many factors outside our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may stop using the Service at any time by canceling your subscription. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your license to the Content immediately ends, except for materials you have already published.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective" date and, for material changes, notify you by email or by posting a notice on the Site. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced within them, constitute the entire agreement between you and the Company regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
